This Privacy Policy explains how Michael Boateng, a real estate sales representative operating as Michael Boateng Real Estate ("we", "us" or "our") and registered with Right At Home Realty, Brokerage, collects, uses, protects and discloses personal information. It applies to michaelboateng.ca, torontocondopro.ca, and any enquiry form we run on social media platforms, including Facebook and Instagram. We are located in Ontario, Canada, and we handle personal information in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and Canada's Anti-Spam Legislation (CASL).

Information We Collect

We collect only what you give us. Depending on how you get in touch, that may include:

• Name
• Email address
• Phone number (optional on our website forms)
• Inquiry details, such as what you are looking to do (buy, sell, lease or invest), your buying or selling timeline, the property, unit or building you are asking about, and anything else you choose to tell us in a message

If we go on to work together on a transaction, we may need additional information that is required to complete it. We will tell you what is needed and why at that time.

How We Collect It

We collect personal information directly from you when you:

• submit a form on one of our websites (for example the contact form or the home evaluation request form)
• submit an enquiry form on Facebook or Instagram
• email us
• call us or leave a voicemail
• send us a text message
• book a call through our online scheduling link

If you submit an enquiry through a form on Facebook or Instagram, that platform may pre-fill some fields from your profile. You can edit them before submitting.

Like most websites, the services that host our sites may automatically log basic technical information, such as your IP address and browser type, to deliver pages and keep the sites secure.

How We Use Your Information

We use your personal information to:

• respond to your inquiries and provide the information you asked for
• contact you about properties or market information relevant to your inquiry
• provide real estate services, including scheduling appointments and showings, sharing property information and providing market updates
• keep records of our communications with you
• meet our record-keeping obligations as a registrant under Ontario's Trust in Real Estate Services Act

We do not use your information for purposes other than those listed here unless we have your consent or are required or permitted to do so by law.

Consent

When you send us an inquiry, you are consenting to our contacting you about it. Under Canada's Anti-Spam Legislation this is treated as implied consent and lasts six months from your inquiry. If you separately ask for ongoing market updates, that is express consent and continues until you withdraw it.

You can withdraw your consent at any time, as described under "How to Opt Out" below. We will act on it promptly, and it will not affect any service you have already asked for.

Text Messaging (SMS)

If you provide your phone number, you may receive text messages from Michael Boateng Real Estate, sent from 647-492-3094, about real estate services. Message frequency varies. Msg and data rates may apply. Providing your phone number is optional, and consent to receive text messages is not a condition of any purchase or service.

Text messaging opt-in data and consent will not be shared with any third parties. The only parties that handle this information are the messaging platform and mobile carriers that deliver our text messages on our behalf, and they may not use it for their own purposes.

SMS Terms and Conditions

1. We use SMS to respond to inquiries, confirm appointments and showings, send reminders, share property information and market updates, and notify clients of schedule updates or important changes.
2. You can cancel the SMS service at any time. Just text "STOP". After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time, and we will start sending SMS messages to you again.
3. If you are experiencing issues with the messaging program, you can reply with the keyword "HELP" for more assistance, or you can get help directly at michael@michaelboateng.ca.
4. Carriers are not liable for delayed or undelivered messages.
5. As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

How We Disclose Information

We do not sell, rent or trade personal information, and we do not share it with third parties or affiliates for marketing or promotional purposes. We disclose personal information only in these limited situations:

• Follow Up Boss, the client relationship management service we use to store client records and manage follow-up.
• Right At Home Realty, Brokerage, where required for transaction records, supervision or regulatory compliance.
• Other service providers, such as website form processing, email, scheduling and messaging tools, only as needed to communicate with you. They process information only on our behalf.
• To complete a transaction you have asked us to carry out, with your knowledge and consent (for example, the other party's brokerage or your lawyer).
• Where the law requires it, for example a regulator, a court order, or the Toronto Regional Real Estate Board where a transaction requires it.

None of these situations involve sharing your text messaging opt-in data or consent for anyone's marketing or promotional purposes.

Some of these providers store data on servers outside Canada, including in the United States, where it may be subject to the laws of that country.

Advertising and Analytics

We advertise on Meta platforms (Facebook and Instagram). If you interact with one of our ads or forms, Meta processes that interaction under its own privacy policy, separately from this one.

Our websites may use standard analytics and advertising tools to understand how visitors find and use the sites. These tools do not tell us who you are personally unless you submit a form.

How to Opt Out

• Text messages: reply STOP to any text message at any time. You will receive one final message confirming that you have been unsubscribed, and no further texts will be sent. Reply HELP for help.
• Emails: click the unsubscribe link at the bottom of any marketing email, or email us at michael@michaelboateng.ca. Unsubscribe requests are processed promptly and no later than 10 business days after we receive them.

You can also withdraw your consent at any time by contacting us using the details below.

Access, Correction and Deletion

Under PIPEDA, you can ask what personal information we hold about you, ask for a copy of it, ask us to correct anything inaccurate or incomplete, and ask us to delete it. To make a request, email michael@michaelboateng.ca or contact us using the details below. We may need to confirm your identity first. We will respond within 30 days.

If you ask us to delete your information and no legal obligation requires us to keep it, we will. If we must keep something, for example records of a real estate transaction, we will tell you.

How Information Is Stored and Protected

Personal information is stored electronically in password-protected systems with two-factor authentication enabled. Access is limited to Michael Boateng and to those who need it to provide the services described above.

We keep inquiry records for as long as needed to respond to you and, if we work together, for the period required for real estate transaction records under Ontario law. No system is perfectly secure, but we take reasonable steps to protect what you give us. If a breach of our safeguards creates a real risk of significant harm, we will notify you and the Office of the Privacy Commissioner of Canada as required by law.
